Terms and conditions of sale

 

Article 1 - Introduction

These Terms and Conditions define the conditions applicable to sales made between the natural or legal persons placing an order through the website www.my-tree.com, referred to as " Customer" and the company MyTree, hereinafter referred to as " MyTree ".

MyTree reserves the right to modify at any time the General Conditions of Sale. They will be applicable as soon as they appear online.

 

Article 2 - Services

MyTree gives its customers the opportunity to take part in the reforestation of the planet by supporting tree planting in areas of the world worst affected by deforestation. Trees funded via the website MyTree are planted by our NGO partners expert in reforestation, from the next planting season.

However, tree funding does not give the Customer any ownership rights in the reforestation project nor the trees funded.

 

Article 3 - Order

The Customer acknowledges having read, at the time of ordering, the General Conditions of Sale and expressly accept them without reservation. These Conditions of Sale shall prevail over all other conditions contained in any other document, unless prior express written consent.

 

Article 4 - Revocation

The Customer may exercise a right of withdrawal within 7 days. In case of exercising the right of withdrawal, MyTree is required to reimburse the sums paid by the customer at no charge. Repayment is due within a maximum period of 15 days.

 

Article 5 - Price

All prices are expressed in euros. It is a final price,, and is inclusive of all taxes, included VAT for France and EEC countries.

 

Article 6 – Payment

The price charged to the customer is displayed on the website at the time of ordering. Payment is made online by credit card or via PayPal for the entire order. Online payment is carried out in strict compliance with banking regulations by the secure payment system provided by the company Payline which is licensed by the Central Service of Security of Information Systems. The Payline cryptographic process ensures complete confidentiality of the information provided by the Customer. Any order is considered valid only after the payment has been accepted by the system chosen (Visa, Mastercard, credit card or PayPal). The data recorded by the payment system constitutes proof of all financial transactions. MyTree reserves the right to refuse any order from a customer with whom there is a dispute or if an NGO partner would not agree to receive funds from a Client.

 

Article 7 - Personal data

MyTree collects personal data on every Client who wishes to receive a planting certificate. These data are intended for useby MyTree and are declared to the CNIL. In accordance with the Data Protection Act (Article 34 of the " Informatique et Libertés" law of 6 January 1978), the Customer has a right to access, rectify, modify and delete personal data. To exercise this right, you only have to write to:  privacy@my-tree.com.

 

Article 8 - Liability

MyTree is automatically liable towards the Client for the proper performance of the contract with the Client. However, MyTree shall not be liable non-performance or improper performance of the contract in case of force majeure, the occurrence of an act attributable to the Customer or any inconvenience, unpredictable and insurmountable damage inherent to the use of the Internet, including interruption of service, external intrusion or presence of computer viruses.

MyTree will implement all means to ensure access to the site 24h a day, 7 days a week, but can not be held responsible for all the issues, website malfunction that would prevent access to the site and/or the different services offered by MyTree. MyTree will do its utmost to solve any problems as soon as possible.

MyTree endeavours to ensure that all information published on the website is accurate and up to date. However, MyTree cannot guarantee a hundred percent accuracy or completeness. Consequently, MyTree can not be held responsible for the information published.

Due to its limited role in the intermediation, the Client recognizes and accepts that MyTree cannot be held responsible in any way and in any manner whatsoever forthe project of its NGOs partners, specially their presentation and their executions.

 

Article 9 - Disputes

This contract is subject to French law. Claims or disputes will always be received with attentive benevolence, good faith is always assumed in someone who takes the trouble to explain his situation. In case of dispute, the customer should first contact the company to obtain an amicable solution. Otherwise, the Paris Commercial Court has exclusive jurisdiction.

 

Article 10 - Intellectual Property

All the elements contained in this website (texts, images, graphics, logos, icons...) are protected by the law of intellectual property and belong to MyTree, subject to rights belonging to third parties.

Any representation, reproduction and exploitation of all or part of the elements composing the site, by any process whatsoever, without the prior written permission of MyTree is strictly prohibited.
